Agreement to these terms

These terms govern your use of starkeymarina.com and the services offered through it by Starkey Marina, 4022 Mundell Road, Eureka Springs, Arkansas 72631 ("Starkey Marina," "we," "us"). By using this website you agree to these terms. If you do not agree, please do not use the site.

Information on this site

We try to keep hours, menus, prices, slip rates and availability accurate, but they can change without notice. Hours are weather dependent. Prices shown do not include tax unless stated. Nothing on this site is a guaranteed offer until confirmed by us.

Online orders, rentals and gift cards

Food orders and gift cards are processed through Toast. Boat, kayak, paddle board and nightly slip bookings are processed through FareHarbor. Those purchases are also subject to the provider's terms and to the booking, cancellation and refund rules shown at checkout. Renters must follow all rental agreements, safety briefings, posted rules and applicable boating laws.

Annual and monthly slip rentals

• Annual slip rentals are paid on an annual basis and renew automatically unless we receive written notice of termination at least 30 days before renewal.
• Annual slip rates are subject to increase without notice.
• Month-to-month slips are offered on a limited basis.
• Taxes and any other applicable fees are added to all slip prices.
• Each slip rental is also governed by the signed slip rental agreement. If that agreement conflicts with these terms, the agreement controls.

Slip waitlist and inquiries

Joining the waitlist or submitting an inquiry does not reserve or guarantee a slip. We will contact waitlisted customers as slips become available, and availability, size and price are confirmed only when a rental agreement is signed.

Text messages

If you opt in to text messages, you agree to receive messages as described in our Privacy Policy. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

Acceptable use

You agree not to misuse the site, including by submitting false information, interfering with its operation, attempting to gain unauthorized access, or using it for any unlawful purpose.

Intellectual property

The Starkey Marina name, logo, photos and content on this site belong to Starkey Marina or its licensors and may not be copied or used without our permission.

Third-party links and services

This site links to and embeds services operated by others, such as Toast, FareHarbor, LeadConnector and Google Maps. We are not responsible for their content, policies or availability.

Disclaimer

This website is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Starkey Marina is not liable for any indirect, incidental or consequential damages arising from your use of this website. This section applies to use of the website only. Activities on the water carry inherent risks, and liability for rentals and slips is governed by the applicable rental or slip agreement.

Governing law

These terms are governed by the laws of the State of Arkansas. Any dispute will be handled in the state or federal courts located in Carroll County, Arkansas.

Changes

We may update these terms at any time. The date at the top of this page shows when they last changed. Continued use of the site means you accept the updated terms.
